2. Account Responsibilities

When you create a GetMyCert account, you agree to:

• Provide accurate, current, and complete information
• Maintain the confidentiality of your password and account credentials
• Accept responsibility for all activity under your account
• Notify us immediately of unauthorized access or suspicious activity
• Use the service only for lawful purposes and for your own educational benefit
• Not create multiple accounts to avoid payment obligations

We reserve the right to refuse service or terminate accounts that violate these Terms.

3. Subscription and Billing Terms

Free Trial

Subscription Plans

• Subscriptions are billed monthly on a recurring basis
• Billing occurs automatically on your renewal date unless you cancel
• We accept credit and debit cards processed through Stripe
• Failed payment attempts may result in service suspension
• You authorize us to charge your payment method for all applicable fees

Price Changes

We may modify subscription prices with 30 days' notice. Price changes take effect on your next renewal date. Continued use of the service after a price increase constitutes acceptance of the new price.

4. Cancellation and Refund Policy

Cancellation

• You can cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• You will retain access until the end of the paid period
• You will not be billed for future periods after cancellation

Refund Policy

• Refunds for full monthly subscriptions are available within 14 days of purchase
• Refunds are issued in the original payment method
• Refunds are not available for partially used subscription periods
• Promotional discounts are non-refundable
• We are not responsible for third-party payment processor issues

5. Intellectual Property Rights

Our Content

• All exam questions, study materials, and educational content are owned exclusively by GetMyCert
• The underlying certifications (CompTIA, Microsoft, AWS, etc.) are owned by their respective organizations
• You are granted a limited, personal, non-transferable license to use the content for your own study
• You may not copy, reproduce, distribute, or sell our questions or materials

Your Content

• You retain ownership of any personal information or study notes you provide
• We may use aggregated, anonymized data from your quiz responses to improve our questions and platform
• We may not identify you personally when using such data

Prohibited Uses

You agree not to:

• Reproduce, copy, or share exam questions with unauthorized individuals
• Modify, translate, or create derivative works from our content
• Use automated tools, bots, or scraping to extract content
• Circumvent authentication or access controls
• Share your account credentials with others
• Interfere with platform functionality or attempt to gain unauthorized access
• Use the service for commercial purposes without explicit permission

6. Limitation of Liability

This includes, but is not limited to:

• Lost profits or revenue
• Loss of data or business opportunities
• Failed exam attempts (our practice tests do not guarantee exam success)
• Service interruptions or data loss
• Third-party claims arising from your use of the service

Our total liability shall not exceed the amount you paid for your subscription in the past 12 months.

Disclaimer of Warranties

GetMyCert is provided "as-is" without warranties of any kind, express or implied. We do not guarantee:

• Exam success or passage of any certification exam
• Uninterrupted service availability
• Error-free or secure platform operation
• Accuracy or completeness of study materials

7. Warranty Disclaimer for Exam Performance

Important: Practice tests and study materials are educational tools to help you prepare. They do not guarantee success on official certification exams. Exam content, difficulty, and format may differ from our materials. Certification decisions are made solely by the respective certification bodies (CompTIA, Microsoft, AWS, etc.), not by GetMyCert.

8. Indemnification

You agree to indemnify and hold harmless GetMyCert, its owners, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the service or violation of these Terms
• Your account activities
• Infringement of intellectual property or other rights
• Any illegal activity or violation of law

9. Prohibited Uses and Conduct

You agree not to use GetMyCert for:

• Illegal activities or violation of any law or regulation
• Harassment, threats, or abusive behavior toward others
• Cheating on official certification exams using our materials
• Transmitting malware, viruses, or malicious code
• Unauthorized access or intrusion attempts
• Any activity that violates others' rights or violates these Terms

We reserve the right to terminate accounts and pursue legal action for violations.

10. Modification of Service

We reserve the right to:

• Modify, suspend, or discontinue any feature or the entire service
• Remove questions or update content based on official certification changes
• Change the platform interface or functionality
• Provide 30 days' notice for material changes that negatively impact existing subscribers

11. Termination

We may terminate or suspend your account immediately, without notice, if you:

• Violate these Terms of Service
• Engage in illegal activity or fraud
• Fail to pay subscription fees
• Violate intellectual property rights
• Abuse the service or other users

Upon termination, you lose access to your account and all content. No refunds are issued for accounts terminated due to violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any disputes arising under or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in the jurisdiction where GetMyCert is incorporated.

Informal Dispute Resolution

Before pursuing legal action, you agree to attempt to resolve disputes informally by contacting us at hello@getmycert.com. We will make a good faith effort to resolve disputes within 30 days.

13. Third-Party Services

Our platform integrates with third-party services including Stripe (payment processing) and Supabase (data hosting). Your use is also governed by their terms of service and privacy policies:

We are not responsible for third-party services or their policies.

14. Severability

These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and GetMyCert regarding your use of the service. Any prior agreements, understandings, or negotiations are superseded. We may update these Terms at any time by posting the updated version on our website. Your continued use constitutes acceptance of the updated Terms.
